EDDIE Oygur of the famed ugg boots name should be applauded for his stance against the US company Deckers over the trademark.

If Deckers do succeed and keep the name, then Deckers should be made to pay import duty of 35 per cent and this be given to Eddie.

Why should he not receive recompense after spending so much to protect his rights?

After years of stoically insisting the Sunshine State remain warm for most of the year, she threw on her Ugg boots and a sensible fleece and blasted us with another day of frigid temperatures.
On their website, Deckers Corporation have said:
‘Australian dealers have attempted to pass off their boots as Deckers’ UGG Australia brand boots…and to deceive or confuse consumers outside of Australia.
‘Deckers takes action against dealers in Australia and elsewhere that are engaged in such deceptive trade practices.’
There are 60 days until the first US District Court hearing and Mr Oygur told The Age he was ‘not scared of a fight’.
‘I am a small Australian company, Australian-owned and Australian-made. But I’d like to have the government behind me to say enough is enough.’
Why didn’t the Australian ugg industry trademark the term in other countries? In the 1970s, the ugg manufacturing industry was a cottage industry, with surf enthusiasts selling the boots in small shops or out of trucks at the beach. The fragmented nature of the industry meant that few retailers were paying attention to global markets, and retail markets in general were far less globalised. To Australian firms, the word ugg was a generic word, so protecting the term as a form of competitive advantage in overseas markets just did not occur to anyone. It was also a much more complex and costly process to register for trademark protection in other countries than it is today, which may have further impeded such action by an Australian industry comprised of small individual proprietors. By the time the ugg boot fashion exploded on the global scene, Deckers already owned the trademark on the term, as well as related terms like “Ughs,” and it was too late for Australian firms.
Activists on behalf of the Australian industry have argued that France can legally prevent sparkling wine from being called champagne, so Australia should be able to similarly protect the word “ugg”. These arguments misunderstand the different tools used to protect intellectual property. The word champagne is protected as a geographical indicator, and it refers to a product from the Champagne region of France, just as Modena Balsamic vinegar refers to balsamic vinegar that comes from the Modena province of Italy. By contrast, there is no state or region in Australia called Ugg that is famous for making ugg boots, so that argument does not apply.

 
In the reception area at Ugg corporate headquarters in Southern California, there is a bound album filled with snapshots of celebrities wearing the company’s products. It is arranged in alphabetical order, with separate sections for women and men, and is the size of the September issue of a fashion magazine, or maybe a small phone book. Many of the photographs are from the brand’s peak cultural moment in the mid-2000s, including six different pictures of Blake Lively and four of Leighton Meester, wearing Uggs between takes on the set of Gossip Girl. But there are enough photos from the past few years to make it clear that Uggs remain a perennial off-duty uniform for the famous: Ariana Grande wearing classic boots at an airport, paired with a massive Louis Vuitton bag; Charlize Theron wearing the Cardy boot, whose knitted exterior is meant to resemble a buttoned cardigan; Emma Watson (again) shopping in a white pair; Rosie Huntington-Whiteley crossing the street wearing Coquettes (Ugg slippers shaped like a flat clog or a boot with the top sliced off, which can be worn indoors or out); Hugh Jackman and the designer Valentino (separately) wearing the Butte snow boot.
